These Terms & Conditions ("Terms") govern your use of the LuxSpace Interiors website at luxspaceinteriors.in ("Website") and the interior design services provided by LuxSpace Interiors ("we", "us", "our") — a design studio headquartered in Gurugram, Haryana, India.
By accessing the Website or engaging our services, you ("Client", "you") agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Website or engage our services.
1. Acceptance of Terms
These Terms form a binding legal agreement between you and LuxSpace Interiors. They apply to all visitors to this Website and to all clients who engage us formally for design services via a signed agreement, quotation acceptance, or payment of advance. By proceeding, you confirm that you are at least 18 years of age and have the legal authority to enter into a contract.
2. Design Services
LuxSpace Interiors offers interior design and related services including but not limited to:
- Residential interior design for apartments, villas, and independent homes
- Commercial interior design for offices, retail spaces, and hospitality venues
- Modular kitchen and wardrobe design and fabrication
- Renovation planning and project management
- Concept design, 3D visualisation, and space planning
The specific scope, deliverables, and inclusions for each project are detailed in the individual Project Agreement signed between LuxSpace Interiors and the client. These Terms supplement — and do not replace — the individual Project Agreement.
3. Quotations and Proposals
- All quotations issued by LuxSpace Interiors are valid for 30 days from the date of issue unless otherwise stated.
- A quotation does not constitute a contract until formally accepted by the client and accompanied by the agreed advance payment.
- Quotations are based on information provided by the client at the time of consultation. Any changes to the scope, area, or specifications may result in a revised quotation.
- Promotional or discounted pricing applies only to the specific project and period mentioned and cannot be applied retrospectively.
4. Payment Terms
Unless a different arrangement is agreed in writing:
- 30% Advance: Payable upon signing the Project Agreement to confirm the booking and begin design work.
- 40% Mid-Payment: Payable upon design approval and before commencement of fabrication or civil work.
- 30% Balance: Payable upon project completion and handover.
All payments are accepted via bank transfer (NEFT/RTGS/IMPS), UPI, or cheque. Receipts will be issued for all payments received. Work will not commence or continue until the applicable milestone payment has been received. LuxSpace Interiors reserves the right to pause work if a milestone payment is delayed beyond 7 days from the milestone date.
5. Client Obligations
To ensure the smooth delivery of your project, you agree to:
- Provide accurate and timely information regarding your space, requirements, and preferences.
- Ensure LuxSpace Interiors and its contractors have safe and reasonable access to the project site during agreed working hours.
- Obtain and maintain all required permissions, No-Objection Certificates (NOCs), and approvals from your housing society, local authority, or building management before construction or civil work begins.
- Attend design review sessions or respond to design queries within 5 business days to avoid project delays.
- Ensure that the project site is free of all existing belongings or obstructions before civil or fabrication work is scheduled to begin.
6. Project Timelines
Estimated project timelines are provided in the Project Agreement and are based on standard working conditions. LuxSpace Interiors shall not be held liable for delays caused by:
- Delayed approvals or feedback from the client
- Changes to the scope or design requested by the client after work has begun
- Delayed payments from the client
- Force majeure events including but not limited to natural disasters, government restrictions, labour strikes, or supply chain disruptions
- Delays caused by third-party vendors or suppliers outside direct control
7. Changes and Revisions
- Design changes requested before the project is approved and work begins are accommodated free of charge (up to two major revision rounds).
- Scope changes or additions made after work has commenced may attract additional charges and may extend the project timeline. A revised quotation will be issued for any additional scope.
- Changes to structural or civil work after commencement will be charged at actuals plus a 15% project management fee.
8. Cancellation and Refunds
- Cancellation before design work has commenced: The advance paid will be refunded minus any out-of-pocket expenses already incurred (site visits, material samples procured, etc.).
- Cancellation after design work has commenced but before site work begins: 50% of the advance will be refunded. The remaining 50% is retained to cover design work already completed.
- Cancellation after site work or fabrication has commenced: No refund of amounts paid. The client is liable to pay for all work completed and materials procured to date.
- Refunds, where applicable, will be processed within 10–15 business days of the written cancellation request.
9. Intellectual Property
All design concepts, drawings, 3D renderings, floor plans, mood boards, and documentation created by LuxSpace Interiors remain the intellectual property of LuxSpace Interiors until full payment has been received for the project.
Upon receipt of full and final payment, the client is granted a non-exclusive, perpetual licence to use the designs for the specific project for which they were created. The client may not reproduce, resell, or use the designs for any other project or purpose without written consent from LuxSpace Interiors.
LuxSpace Interiors reserves the right to use project photography and descriptions for portfolio, marketing, and promotional purposes, including on our website and social media, unless the client explicitly requests confidentiality in writing before project completion.
10. Limitation of Liability
LuxSpace Interiors shall not be liable for:
- Indirect, consequential, or incidental losses arising from the use of our services or this Website.
- Inaccuracies in project execution caused by incorrect or incomplete information provided by the client.
- Damage, defects, or failures in materials, products, or finishes arising from the manufacturer's defect or misuse by the client after handover.
- Losses arising from acts of third parties including contractors, suppliers, or government authorities.
Our total liability to any client for any claim shall not exceed the total amount paid by that client for the specific project to which the claim relates.
11. Website Use
You may use this Website for lawful, personal, and non-commercial purposes only. You agree not to:
- Copy, reproduce, or distribute any content from this Website without written permission.
- Use any automated scraping, crawling, or data harvesting tools on this Website.
- Attempt to interfere with the security or functionality of this Website.
- Post or transmit any unlawful, harmful, or offensive content through any contact form or communication channel on this Website.
The content on this Website including text, images, logos, and design elements is owned by or licenced to LuxSpace Interiors and is protected by Indian intellectual property law.
12. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or the services provided by LuxSpace Interiors shall first be attempted to be resolved through amicable mutual discussion.
If a dispute cannot be resolved within 30 days, it shall be subject to the exclusive jurisdiction of the courts in Gurugram, Haryana, India.
Arbitration: At the sole discretion of LuxSpace Interiors, disputes may be referred to binding arbitration under the Arbitration and Conciliation Act, 1996 (India) with a single arbitrator mutually agreed upon by both parties. The place of arbitration shall be Gurugram, Haryana.
